washer will drain, but will not spin. it will agitate, rinse, drain ,but it will not spin the tub. If the agitate is working i have to believe the belt, motor and the transmission are fine. I am leaning towards the timer but not sure. any help would be appreciated theres not to much out there on the internet or these forums about these washers (lucky me).

Check out the lid switch by testing it for continuity. If it is not working correctly change it out, here is the part.

checked the switch its working fine you can see the washer pump shut on and off evertime i push on it with a srewdriver when its supposed to go into spin.

Ok, I would next replace the timer, but before doing so check to see that the motor is not turning when it is in spin mode, and check all the wiring between the motor and the timer.
If you order from this site and the timer does not fix the problem you may be able to return it for a refund. Check the returns policy or talk with APP to see what you need to do.
